(A) Public utility and right-of-way maintenance. The permit requirements of this chapter shall not apply to public utility and right-of-way maintenance projects.
(B) Emergencies. The provisions of this chapter shall not apply to emergency activity by any governmental agency or utility company necessary to protect life or prevent substantial harm to persons or property.
(C) BMP requirements. Notwithstanding the foregoing clauses in this section, all land disturbing activity shall be completed in accordance with the BMP standards set forth in this chapter for projects for which an NRMP is required.
