§ 130.07 FIREWORKS REGULATIONS.
   (A)   Adoption of M.S. §§ 624.20 to 624.25. The provisions of M.S. §§ 624.20 to 624.25, as amended (2004), are hereby adopted and incorporated herein by reference as though set forth verbatim herein.
   (B)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CONSUMER FIREWORKS. Wire or wood sparklers of not more than 100 grams of mixture per item, other sparking items which are non-explosive and non-aerial and contain 75 grams or less of chemical mixture per tube, or a total of 500 grams or less for multiple tubes, snake and glow worms, smoke devices, or trick noise makers which include paper streamers, party poppers, string poppers, snappers, and drop pops each consisting of not more than 25/100 grains of explosive mixture, toy pistols and toy guns in which paper caps containing 25/100 grains or less of explosive compound are used, or toy pistol caps which contain less than 20/100 grains of explosive mixture.
      FIREWORKS. Any substance or combination of substances or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration, or detonation, and includes blank cartridges, toy cannons, and toy canes in which explosives are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, skyrockets, roman candles, daygo bombs, sparklers other than those identified as consumer fireworks, or other FIREWORKS of like construction and any FIREWORKS containing any explosive or inflammable compound, or any tablets or other device containing any explosive substance and commonly used as FIREWORKS. Consumer fireworks shall not be deemed FIREWORKS.
   (C)   Sale, possession, and use of fireworks prohibited.
      (1)   Fireworks. Except as otherwise permitted under M.S. §§ 624.20 through 624.25, it is unlawful for any person to sell, offer for sale, store, possess, use, or explode any fireworks within the city.
      (2)   Consumer fireworks.
         (a)   No person under the age of 18 years shall purchase any consumer fireworks.
         (b)   No person shall use or discharge any fireworks or consumer fireworks between the hours of 10:00 p.m. and 8:00 a.m., except on July 4 the prohibited hours shall be from 11:59 p.m. on July 4 to 8:00 a.m. on July 5 and on January 1 the prohibited hours shall be from 12:30 a.m. to 8:00 a.m.
      (3)   Fireworks and consumer fireworks.
         (a)   No person shall throw, toss, or otherwise dispose of any fireworks or consumer fireworks at or in the direction of any person, animal, vehicle, thing, or object.
         (b)   No person shall throw, toss, or otherwise discard any fireworks or consumer fireworks from a vehicle, moving or non-moving.
         (c)   No consumer fireworks shall be kept, stored, used, permitted or discharged on any public property or on any public street or right-of-way.
      (d)   No person shall use or discharge consumer fireworks within any building or structure.
   (D)   The sale of consumer fireworks within the city requires a license and fee as indicated in Chapter 120 of the city code.
