(A) Zones 1 and 2. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Community-based family-care home or day-care home not licensed by the state under M.S. § 245.812 or a community-based residential-care facility or day-care facility in a multiple dwelling when:
(a) Facility meets all existing health, fire, building and housing codes; and
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant exception to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities.
(2) A conditional use permit shall be reviewed at one-year intervals.
(B) Zone 3. There are no conditional uses provided.
(C) Zone 4A. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Bowling alley or similar commercial recreation facility;
(2) On-sale liquor in conjunction with a restaurant facility;
(3) Outdoor display or sales conducted by an occupant of a shopping center. Outdoor area to be screened and maintained in a manner to be approved by the City Council; and
(4) Restaurant, Class II, either freestanding or contained within a shopping center. Such use may be located no closer than 500 feet to the right-of-way line of a minor or principal arterial road unless the Class II restaurant meets the following requirements:
(a) Hours of operation are limited to 10:00 a.m. to 11:00 p.m. daily; and
(b) The Class II restaurant does not serve foods which require the installation of a Type I ventilation hood (grease and smoke removing) as defined in the Uniform Mechanical Code.
(D) Zone 4B. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Motor fuel station and/or service station with minor auto repair facilities;
(2) On-sale liquor in conjunction with a restaurant facility;
(3) Outdoor display or sales conducted by an occupant of a shopping center. Outdoor area to be screened and maintained in a manner to be approved by the City Council;
(4) Private clubs and lodges not operated for a profit; and
(5) Service bays for the installation of auto accessories, in conjunction with auto accessories store, provided there are no more than three bays which shall be screened and oriented as required by the City Council.
(E) Zone 5. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Nursing homes, rest homes, retirement homes or hospitals for human care, day care centers and private schools;
(2) Funeral homes and mortuaries;
(3) Art, interior decorating, photographic or music studio provided no retail sales are made of products not manufactured on the site;
(4) Radio and television studios;
(5) Private clubs and lodges not operated for a profit;
(6) Historical buildings, museums, art institutes, galleries and playhouses;
(7) Off-street parking when the principal site of the off-street parking abuts on a lot which is in another zoning district;
(8) On-sale liquor in conjunction with a restaurant facility; and
(9) Restaurants, Class I only.
