(A) Zones 1, 2 and 7. Within these zones, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Community-based family-care home or day-care home not licensed by the state under M.S. § 245.812 where:
(a) Facility meets all existing health, fire, building and housing codes; or
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant, except to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities.
(2) The conditional use permit shall be reviewed at one-year intervals.
(B) Zone 3. There are no conditional uses provided.
(C) Zone 4. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Community-based family-care home or day-care home not licensed by the state under M.S. § 245.812 or a community based residential care facility or day care facility when:
(a) Facility meets all existing health, fire, building and housing codes; or
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant exception to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities.
(2) A conditional use permit shall be reviewed at one-year intervals.
(D) Zone 5. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Community-based family-care home or day-care home not licensed by the state under M.S. § 245.812 where:
(a) Facility meets all existing health, fire, building and housing codes;
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant exception to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities; and
(c) The conditional use permit shall be reviewed at one-year intervals.
(2) Any structure otherwise permitted but exceeding 40 feet in height.
(E) Zone 6. Within this zone, no structure or land shall be used for the following uses or uses deemed similar by the City Council, except through the granting of a conditional use permit:
(1) Community-based family-care home or day-care home not licensed by the state under M.S. § 245.812 contained within a one- or two-family dwelling where:
(a) Facility meets all existing health, fire, building and housing codes;
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant exception to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities; and
(c) A conditional use permit shall be reviewed at one-year intervals.
(2) Community-based residential-care facility or day-care facility in a multiple dwelling where:
(a) Facility meets all existing health, fire, building and housing codes;
(b) Separation of one-quarter mile exists between the facilities. The City Council may grant exception to the one-quarter mile rule when either strong community support exists, program effectiveness is closely tied to particular cultural resources in the community, or an effective natural or man-made barrier exists between facilities; and
(c) A conditional use permit shall be reviewed at one-year intervals.
