§ 93.99 PENALTY.
   (A)   Any person, firm, or corporation or his, her, or their agents who violates any provisions of this subchapter or who fails or refuses to obey a lawful order of the Property Maintenance Officer or the Village Police Department, issued pursuant to this chapter is guilty of a minor misdemeanor as defined by the Ohio Revised Code and shall be fined not more than $100. Each day during which any such violation continues shall be considered to be and charged as a separate offense and violation.
   (B)   Further, upon any subsequent offense after a prior conviction for the same violation, the degree of the misdemeanor shall escalate by one degree as follows: a second offense shall constitute a fourth degree misdemeanor; a third offense shall constitute a third degree misdemeanor; a fourth offense shall constitute a second degree misdemeanor; and a fourth offense or more shall constitute a first degree misdemeanor.
