§ 93.46 ABATEMENT OF VIOLATIONS.
   (A)   Where the owner and/or occupant of any premises fails to comply with a notice of violation of any of the provisions within the time period specified in the notice, the Property Maintenance Officer may cause such violation to be corrected, removed, or abated.
   (B)   The Property Maintenance Officer may contract with a private person or firm to accomplish the task. The actual cost of bringing the property into compliance plus 15% for inspections and administration shall be billed to the owner. If the bill is not paid within 30 days after submission, then the Village Fiscal Officer shall certify said costs, together with a 10% penalty, to the County Auditor for placement on the tax duplicate to be collected as other taxes for return to the village.
   (C)   A statement of the cost thereof shall be mailed to the owner and/or occupant of any premises by certified mail, return receipt requested. Upon failure of such service, ordinary mail shall suffice.
   (D)   Such statement of cost may include the following:
      (1)   Administration and supervision;
      (2)   Transportation of equipment;
      (3)   Equipment rental;
      (4)   Equipment operator;
      (5)   Incidental labor; and
      (6)   Contractor labor.
   (E)   The minimum fee to be charged when the village is forced to remediate shall in no case be less than $75 for the first hour or portion thereof, and $50 for each additional hour or portion thereafter. The cost will also be $75 per hour on each piece of village equipment used.
