§ 93.42 INSPECTIONS, RIGHT OF ENTRY, AND ENFORCEMENT OF ORDERS AUTHORIZED.
   (A)   The Property Maintenance Officer or other designated official is authorized to make, or cause to be made, external inspections of all structures or premises used for dwelling purposes, and all secondary or appurtenant structures, to determine whether such structures or premises conform to the provisions of this chapter. The Property Maintenance Officer or other designated official is also authorized to perform, or cause to be performed, whatever work is necessary to bring nonconforming property into conformity to the provision of this chapter and recoup the cost there from pursuant to this chapter.
   (B)   When a property owner denies the Property Maintenance Officer or other designated official entry onto their property for the purpose of making an exterior inspection, refuses to comply with an order of the Property Maintenance Officer or other designated official, the Property Maintenance Officer or other designated official may apply for and obtain a search warrant or a court order from the court of competent jurisdiction to gain access to the property for the purposes of inspection or enforcing of the chapter.
   (C)   Nothing contained in this section shall limit the right of immediate entry by the Property Maintenance Officer or other designated official onto any property in the village when he or she determines that an emergency exists.
