§ 52.23 EXTRA STRENGTH WASTE CHARGES AND CONTRACTS.
   (A)   (1)   For each nonresidential user discharging wastes with BOD5 and suspended solids concentrations greater than those specified in § 52.21(B)(8), the Board of Public Affairs can waive the requirements of § 52.22 and levy a surcharge for such wastes in addition to any other sewer charges outlined in the most current sewer rate ordinance in effect. The surcharge for such wastes shall be determined using the following formula:
         (a)   Cs = .00834 [Bc (B-200 + Sc (S-250)] Vu
         (b)   Where:
            1.   Cs=Surcharge per quarter;
            2.   Bc=Operation and maintenance cost for treatment of a pound of BOD;
            3.    B=Concentration of BOD (mg/l) from user;
            4.   Sc=Operation and maintenance cost for treatment of a pound of suspended solids;
            5.    S=Concentration of suspended solids (mg/l) from user; and
            6.   vu=Volume contribution from user in 1,000 gallons of billable flow per quarter.
      (2)   The unit operation, maintenance, and replacement costs for treatment of BOD and suspended solids are obtained by separating the annual operation, maintenance, and replacement costs into the parameters of flow, BOD, and SS using the percentage breakdown of 50% for flow, 25% for BOD and 25% for SS. The unit charges for BOD and SS are obtained by dividing the annual operation, maintenance, and replacement cost for each parameter by the annual billable pounds for each parameter.
   (B)   No provision contained in this chapter shall be construed to prevent or prohibit a separate or special contract or agreement between the village and any nonresidential user whereby waste and material of unusual strength, character, or composition may be accepted by the village for treatment subject to additional payment therefor by the nonresidential user; provided, however, that such contract or agreement shall have the prior approval of the Village Council.
   (C)   Payment of bills for extra strength wastes shall be handled in the same manner as other sewer charges outlined in the most current sewer rate ordinance in effect. This also applies to delinquent bills and nonpayment of bills.
