(A) Pursuant to R.C. § 9.312, the Council finds and declares that whenever the appropriate corporate or administrative officials of the village shall decide to procure any materials, equipment or supplies, or to contract for labor, services or work of any nature, or to purchase, lease, or sell any personal property by free open competitive bidding in the open market in a manner calculated to ensure the best interest of the public, the award for those services shall be made to the lowest, responsive, and responsible bidder, or in the appropriate instance, to the highest responsible bidder, depending upon whether the municipality is to expend or to receive money.
(B) The factors that the village shall consider in determining whether a bidder on the contract is responsible include the experience of the bidder, its financial condition, its conduct and performance on previous contracts, its facilities, its management skills, and its ability to execute the contract properly. An apparent low bidder found not to be responsive and responsible shall be notified by the village of that finding and the reasons for such.
