(A) Establishment of office. In accordance with the authority for the establishment of a Village Administrator granted to the village in R.C. § 735.271, as amended, the position of Village Administrator is hereby established.
(B) Appointment of Village Administrator. The Village Administrator shall be appointed by the Mayor, but shall not take office unless his or her appointment has been approved by a majority vote of the members elected to Village Council. The Village Administrator need not be an elector or resident of the village. The Village Administrator shall not, however, be an elected official of the village at the time of his or her appointment, or during the tenure of his or her office.
(C) Compensation. The Village Administrator shall receive such compensation as the Village Council shall determine by resolution or ordinance.
(D) Duties. The Village Administrator shall oversee all affairs regarding management and operations of the village’s public utilities, principally being its water and sewer systems. The Village Administrator shall have those powers provided by R.C. § 735.273, as may be amended from time to time. Primary expectations for the position involve the collection of utility fees and addressing in a timely manner any problems or complaints by village residents. The Village Administrator shall work in conjunction with any Public Utility Committee as established by Village Council to better serve the public’s interests, which may involve addressing complaints regarding services or fees. In no instance shall the Village Administrator have authority to determine rates for public utility services, as said authority is vested solely with Village Council.
(E) Removal of Village Administrator. The Village Administrator shall serve at the pleasure of the Mayor and Village Council, and may be removed:
(1) Without cause by the Mayor with the consent of a majority of the members of Village Council; or
(2) Without cause by the affirmative vote of three-fourths of Village Council, without the consent of the Mayor. Village Council may abolish the position of Village Administrator by ordinance.
(F) Abolition of Board of Trustees of Public Affairs. Upon establishment of the position of Village Administrator, and his or her appointment by the Mayor and confirmation by Council, the Board of Trustees of Public Affairs shall be abolished and the term of office of members of such Board shall terminate in accordance with R.C. § 735.272. All contracts entered into by said Board of Trustees and rules and regulations and other action taken by such Board shall continue in effect until they have terminated of their own accord or until they shall have been modified, changed, revised, amended, or repealed in the manner provided by law. In the event Village Council abolishes the position of Village Administrator, a Board of Trustees shall be reestablished by operation of law.
