§ 150.62  SMALL WIND TURBINES.
   (A)   Definitions.   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   SMALL WIND ENERGY SYSTEM.  A wind energy conversion system consisting of a wind turbine, a tower, and associated control or conversion electronics, which has a rated capacity of not more than 100kW and which is intended for non- commercial use and to primarily reduce on-site consumption of utility power.
      (2)   TOWER HEIGHT.  The height above grade measured to the highest point of the blade tip.
   (B)   Setbacks.  No part of the small wind energy system shall extend closer to any property line a distance of less than twice the tower height.
   (C)   Noise.  Noise levels attributable to the small wind energy system may not exceed 45dbC (within a reasonable margin of error) as measured from the property line.
