Sanitary landfill shall be authorized and permitted in the township by any person, persons, partnership, company or corporation, upon compliance with the following rules and regulations.
(A) Any person, persons, partnership, company or corporation shall make written application to the Supervisors of the township, requesting permission to operate a sanitary landfill in and upon the specific area described in such application.
(B) The application shall designate the date of application; name of the person, persons, partnership, company or corporation applying: for the permit; the address of such person, persons, partnership, company or corporation applying for said permit; an exact description of the area, and the location of said area, to be used for such purpose; a promise by the person, persons, partnership, company or corporation so applying for permission to be bound by the rules and regulations; the signature or other proper execution of the person, persons, partnership, company or corporation applying for permission and any other information which the Supervisors may determine necessary or desirable in determining if a permit should be granted.
(C) The application for permission to engage in sanitary landfill shall be accompanied by a $10 deposit in cash or certified check, which shall be credited on the permit fee if a permit to operate is granted. In the event that a permit is refused, the said $10 fee shall be forfeited to the township as a charge for inspecting the area set forth in the application.
(D) If the area requested to be used for sanitary landfill is so located and situated that it will not be a nuisance to surrounding property owners and/or residents of the area, and the area is adaptable to use for sanitary landfill, the Supervisors of the township, shall grant a permit to proceed with a sanitary landfill in only the specific area described in the application, upon payment of the amount of $25, which together with the $10 deposit accompanying the application shall entitle the applicant to use only the specific area described for sanitary landfill for a period of one year, provided that the said licensee abides by all the rules and regulations applicable to said operation. A like fee of $35 shall be due and payable one year from the date the permit is first granted and on the corresponding date of each year thereafter that the operation is continued.
(E) The Supervisors shall have the power to revoke any permit so issued for violation of the rules and regulations and/or change in the development of the area in which the said sanitary landfill is located or the area immediately surrounding it.
