§ 93.25  REVIEW OF APPLICATION; ISSUANCE OF PERMIT.
   (A)   The application shall be reviewed by the engineer or Township Superintendent, who shall determine if the proposed construction will:
      (1)   Eliminate the hazardous effects of stormwater runoff;
      (2)   Protect the township road from damage by the construction; and
      (3)   Comply, in general, with the township design requirements promulgated by PennDOT Publication Number 70, Chapters 441 and 459 of Title 67 and the design criteria of the other publications incorporated therein by reference which are in effect as of the date the application is filed. Requested deviations from PennDOT requirements and design criteria must be approved in writing by the engineer or Township Superintendent.
   (B)   If the plans meet the criteria set forth in divisions (A)(1) through (A)(3) above, the engineer or Township Superintendent shall so advise the Board, whereupon the Board shall issue the permit within 30 days.
   (C)   If the plan is found to be deficient, or if in the opinion of the engineer or Township Superintendent the plan should be improved or amended to meet the criteria set forth in divisions (A)(1) through (A)(3) above, the engineer or Township Superintendent shall notify the owner in writing of the changes to be made, whereupon the applicant shall make such changes and return the revised plans to the township. When the plan is acceptable to the engineer or Township Superintendent, the Board shall issue the permit within 30 days.
