§ 54.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   Sections 54.01 through 54.07 shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the State Rules of Criminal Procedure. Any person who violates or permits the violation of §§ 54.01 through 54.07 shall, upon conviction in a summary proceeding, be punishable by a fine of not more that $1,000 or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense. Each section of §§ 54.01 through 54.07 that is violated shall also constitute a separate offense.

   (C)   Either the Agency or the municipality shall have the authority to enforce the provisions of § 54.26 by either a criminal complaint, as set forth in division (C)(1) below, or by civil penalties, as provided for in division (C)(2) below.
      (1)   Criminal complaint. Any person who violates a provision of § 54.26 shall, upon conviction thereof by summary proceedings, be sentenced to pay a fine of not less than $100 and not more than $300 and/or a period of imprisonment in the county prison for a period not in excess of 30 days.
      (2)   Civil penalties. The civil penalties procedure that has been adopted by the Agency shall, upon notice given to any person, as deemed in § 54.21, who is alleged to be in violation of § 54.26, be invoked and followed. Prior to proceeding under the civil penalties procedure, notice shall be given to the alleged violator that the civil penalties procedure will be invoked, and a complete copy of the then current rules of procedure of the Agency shall be provided to the alleged violator by certified mail.

   (D)   Sections 54.40 through 54.51 shall be enforced by action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the State Rules of Criminal Procedure. Any person who violates or permits the violation of §§ 54.40 through 54.51 shall, upon conviction in a summary proceeding, be punishable by a fine of not more that $1,000 or by imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues, or is permitted to continue, shall constitute a separate offense. Each section of this §§ 54.40 through 54.51 that is violated shall also constitute a separate offense.
