8-2-9-7: REPORTS OF POTENTIAL PROBLEMS:
   A.   Initial Notification: In the case of any discharge, including, but not limited to, accidental discharges, discharges of a non-routine, episodic nature, a non-customary batch discharge, or a slug load, that may cause potential problems for the POTW, any user shall immediately telephone (within fifteen (15) minutes), and notify the pretreatment coordinator of the incident. If this notification cannot be made to the POTW staff during routine business hours, the user shall notify the village police department. This notification shall include the location of the discharge, physical state of discharge, chemical composition, concentration and volume, if known, and date and time of discharge as well as duration of the discharge, and corrective actions taken by the user. The notification shall include what federal, state and local entities have also been notified by the user.
   B.   The user shall control production of all discharges to the extent necessary to maintain compliance with all applicable regulations upon reduction, loss or failure of its treatment facility until the facility is restored or an alternative method of treatment is provided. This requirement includes the situation where, among other things, the primary source of power of the treatment facility is reduced, lost or fails.
   C.   Written Notification: Within five (5) working days following such discharge, the user shall, unless waived by the pretreatment coordinator, submit a detailed written report describing the cause(s) of the discharge and the measures to be taken by the user to prevent similar future occurrences. The report may also include further defined dates when updates or progress reports will be submitted for activities not completed at the time of the written notification.
   D.   Notification Not A Relief Of Liability: Such notifications shall not relieve the user of any expense, loss, damage, or other liability which may be incurred as a result of damage to the POTW, natural resources, or any other damage to person or property; nor shall such notification relieve the user of any fines, penalties, or other liability which may be imposed pursuant to this chapter.
   E.   Employee Notification Procedure: A notice/sign shall be permanently posted on the user's bulletin board or other prominent place advising employees in English and the language of common use whom to call in the event of a discharge described in subsection A, above. Employers shall ensure through documentation that all employees, who may cause such a discharge to occur, are advised of the emergency notification procedure. (Ord. 20-08-25, 8-10-2020)
