(A) Governing body.
(1) Appeals. Any aggrieved person, or any department, commission, board or bureau of the city, that is affected by a decision of the Planning and Zoning Commission in the administration or enforcement of any resolution, rule or regulation adopted pursuant to NMSA § 3-19-12 may appeal such decision to the governing body. Such appeal must be initiated in writing within 15 days after the decision made by the Planning and Zoning Commission when an appeal alleges that there is error in any order.
(2) Requirements. Regarding decisions or determinations by the Planning and Zoning Commission in the enforcement of this subchapter or any other resolution, rule or regulation adopted pursuant to the above-stated state statutes, the governing body, by a majority vote of all of its members, may modify, reverse or affirm any order, requirement, decision or determination of the Planning and Zoning Commission.
(B) District Court. Any person aggrieved by a determination of the governing body may appeal to the District Court within 30 days after the determination made by the governing body.
