§ 10-2-110. Police powers.
   (a)   Compliance with law. In accepting a franchise, a franchisee:
      (1)   acknowledges that its rights under the franchise are subject to the police powers of the County to adopt and enforce ordinances necessary to the safety and welfare of the public; and
      (2)   agrees to comply with all applicable ordinances enacted by the County under its police power.
   (b)   Conflict of laws. Except as provided in subsection (c), a conflict between the provisions of this article and any other lawful exercise of the County's police power shall be resolved in favor of the County's police power.
   (c)   Exception. An exercise of the police power that is inconsistent with this article and that applies exclusively to a particular person or is otherwise not of general application in the County shall prevail only if the County finds that an emergency exists that constitutes a danger to health, safety, property, or general welfare or if the exercise of the police power is mandated by law.
