§ 3 CURFEW FOR MINORS.
   (A)   Curfew for minors. It shall be unlawful for any minor under the age of 18 years, to be upon the public streets, sidewalks, alleys or any other unsupervised place between the following hours:
      (1)   10:00 p.m. Sunday through 6:00 a.m. Monday;
      (2)   10:00 p.m. Monday through 6:00 a.m. Tuesday;
      (3)   10:00 p.m. Tuesday through 6:00 a.m. Wednesday;
      (4)   10:00 p.m. Wednesday through 6:00 a.m. Thursday;
      (5)   10:00 p.m. Thursday through 6:00 a.m. Friday;
      (6)   12:00 midnight Friday through 6:00 a.m. Saturday; and
      (7)   12:00 midnight Saturday through 6:00 a.m. Sunday.
   (B)   Curfew exceptions. This section does not apply to a minor who is:
      (1)   Accompanied by a parent, guardian, or custodian;
      (2)   Accompanied by an adult specified by a parent, guardian, or custodian;
      (3)   Carrying out an errand or other lawful activity as directed by a parent, guardian, or custodian;
      (4)   Occupying the sidewalk of the place where the minor resides, or the sidewalk of a place where the minor has permission from his or her parent or guardian to be, or the sidewalk of a next-door neighbor not communicating an objection to a police officer; or
      (5)   Participating in, going to, or returning from:
         (a)   Lawful employment;
         (b)   A lawful athletic, educational, entertainment, religious, or social event; or
         (c)   Interstate travel.
   (C)   Responsibility of parent. It shall be unlawful for any parent, guardian or other person having the lawful care, custody or control of any minor under the age of 18 years to allow or permit the person to violate the provisions of division (A) of this section. It shall be prima-facie evidence of violation of this division that the child of a parent, guardian or other person having custody was found in violation of division (A) of this section.
   (D)   Aiding and abetting violators of curfew. It shall be unlawful for any person over the age of 18 years to aid, abet, influence, contribute or encourage a minor in violating division (A) of this section.
   (E)   Penalty.
      (1)   A minor violating the provisions of division (A) of this section shall be dealt with in accordance with Juvenile Court law and procedure.
      (2)   Whoever violates divisions (C) and (D) of this section shall be guilty of a minor misdemeanor.
      (3)   Whoever violates divisions (C) and (D) of this section, having been previously convicted of a violation of divisions (C) and (D) of this section, shall be guilty of a misdemeanor of the fourth degree.
