§ 40.23 LAW ENFORCEMENT TRUST FUND.
   (A)   The Ohio Revised Code § 2981.13 allows for the creation of a fund to receive and expend moneys received from the sale of forfeited property and forfeited funds due to law enforcement matters and mandates that a Law Enforcement Trust Fund be established for such moneys.
   (B)   The Prosecutor for Shelby County will determine the amount to be conveyed to the village and so the village will establish such a fund to receive and expend such moneys.
   (C)   The Law Enforcement Trust Fund will be established with the fund number 2091.
   (D)   The Ohio Revised Code also mandates that no amounts shall be allocated or used unless the village has adopted a written internal control policy that addresses the use of moneys as is set forth in division (E) below.
   (E)   Law Enforcement Trust Fund Policy.
      (1)   Ohio Revised Code § 2981.13 allows for the creation of a fund to receive and expend moneys received from the sale of forfeited property and forfeited funds due to law enforcement matters and mandates that a Law Enforcement Trust Fund be established for such moneys. The Ohio Revised Code goes on to state that an internal control policy be written to address the use of such moneys.
      (2)   All funds received by law enforcement shall be processed as follows: After the funds are released from the Shelby County Prosecutor, the Village Police Chief shall immediately give them to the Village Fiscal Officer to be deposited into the Law Enforcement Trust Fund. The Fiscal Officer will issue a receipt, and the Police Chief shall keep a copy and file accordingly with his or her records.
      (3)   All funds to be expended from the Law Enforcement Trust Fund must be authorized by the Village Council prior to use. The appropriated funds shall be expended only in accordance with this policy and, subject to the requirements specified in this section and only for the following purposes:
         (a)   To pay for the costs of complex investigations involving major crimes;
         (b)   To pay for the costs of training (only the fees for the actual training and no supplemental fees such as wages, meals, mileage, etc.);
         (c)   To provide matching funds to obtain federal grants to aid law enforcement with respect to the dangers associated with the use of drugs er of abuses; and
         (d)   For other law enforcement purposes that the Council determines to be appropriate.
