§ 153.175 ADMINISTRATIVE ENTITIES.
   (A)   General provisions.
      (1)   The formulation, administration and enforcement of these regulations is hereby vested in the following offices of the Village of Anna:
         (a)   The Zoning Administrator;
         (b)   The Planning Commission;
         (c)   The Board of Zoning Appeals; and
         (d)   The Village Council.
      (2)   All departments, officials and public employees of the Village of Anna vested with the duty or authority to issue permits, certificates or licenses shall conform to the provisions of these regulations and shall issue no permit, certificate or license for any use, building, structure or purpose if the use, building, structure or purpose is in conflict with the provisions of these regulations. Any permit, certificate or license issued in conflict with the provisions of these regulations shall be deemed null and void.
   (B)   Zoning Administrator.
      (1)   Authority.
         (a)   The Village Administrator shall be the Zoning Administrator.
         (b)   If the position of Village Administrator is vacant or ceases to exist, the Mayor, with the approval of the Village Council, shall appoint a Zoning Administrator.
      (2)   Duties and responsibilities. It shall be the duty of the Zoning Administrator or his or her designee to:
         (a)   Enforce the provisions of these regulations;
         (b)   Interpret the zoning regulations text and official zoning district map;
         (c)   Issue zoning permits in accordance with these regulations and maintain a complete record of all zoning permits issued;
         (d)   Advise the Planning Commission, the Board of Zoning Appeals and the Village Council of all matters pertaining to issues upon which they need to act and to provide all documents, maps and any other related material that the Planning Commission, Board of Zoning Appeals or Village Council requests;
         (e)   Determine whether various uses of land within the area of the village are in compliance with these regulations;
         (f)   Maintain and keep the permanent records required by these regulations, including but not limited to the official zoning district map, zoning permits, inspection records, and all official zoning actions of the Village Council, Planning Commission and the Board of Zoning Appeals; and
         (g)   Inspect any premises being constructed under a zoning permit or any building being used in conjunction with a conditional use permit in the village to ensure compliance with these regulations.
   (C)   Planning Commission.
      (1)   Authority. The Planning Commission shall be constituted and carry out its duties and responsibilities as prescribed in R.C. Chapter 713. The Planning Commission shall consist of five members, consisting of the Mayor, one member of Council and three citizens of the village to be appointed by the Mayor and approved by the Village Council, for terms of six years each. Vacancies shall be filled in the same manner for the unexpired term of the vacant seat.
      (2)   Quorum.
         (a)   Three members shall constitute a quorum.
         (b)   The majority vote of the quorum shall be necessary to take any official action.
      (3)   Duties and responsibilities. It shall be the duty of the Planning Commission to:
         (a)   Review and make recommendations on proposed zoning regulations, the official zoning district map and all proposed zone changes for consideration by the Village Council;
         (b)   Review development plans within the Planned Unit Development Districts and make recommendations regarding those plans to the Village Council;
         (c)   Review site plans for proposed non-residential development and for residential development when more than two dwelling units per structure are proposed; and
         (d)   Keep minutes of its proceedings, showing records of all official actions of the Commission.
   (D)   Board of Zoning Appeals (BZA).
      (1)   Authority.
         (a)   The Board of Zoning Appeals shall be constituted and carry out its duties and responsibilities as prescribed in the Ohio Revised Code.
         (b)   The BZA shall consist of five members, appointed by the Mayor and approved by the Village Council, for terms of five years.
         (c)   Vacancies shall be filled in the same manner for the unexpired term of the vacant seat.
      (2)   Quorum.
         (a)   Three members shall constitute a quorum.
         (b)   The majority vote of the quorum shall be necessary to rectify an administrative appeal, grant a variance, grant a conditional use permit, or to take any official action.
      (3)   Duties and responsibilities. It shall be the duty of the BZA to:
         (a)   Hear and decide appeals of administrative decisions;
         (b)   Authorize variances;
         (c)   Authorize the issuance of conditional use permits;
         (d)   Authorize extensions of the time period for which a zoning permit is issued or authorize issuance of a new permit when circumstances beyond the control of the applicant prohibit completion of construction within one year;
         (e) Decide any questions involving the interpretation of the zoning regulations or map; and
         (f)   Keep minutes of its proceedings, showing records of all official actions of the BZA.
      (4)   Appeals. Appeals from decisions of the Board of Zoning Appeals shall be filed in the Shelby County Common Pleas Court.
   (E)   Village Council.
      (1)   Authority. The Village Council shall carry out its duties and responsibilities relative to these regulations as prescribed by R.C. Chapter 713.
      (2)   Duties and responsibilities. It shall be the duty of the Village Council to:
         (a)   Approve the Mayor’s appointment of a Zoning Administrator when the position of Village Administrator is vacant or ceases to exist;
         (b)   Approve the Mayor’s appointment of the members of the Planning Commission;
         (c)   Approve the Mayor’s appointment of the members of the Board of Zoning Appeals;
         (d)   Act upon suggested amendments to the zoning regulations or official zoning district map upon recommendation of the Planning Commission; and
         (e)   Act upon suggested development plans for Planned Unit Development (PUD) Districts upon recommendations of the Planning Commission.
