183.05 REFERENCED CODES - CONFLICTS.
In the event requirements of this code conflict with applicable State and Federal requirements, the more stringent shall apply.
183.06 SECTION 101.1 AMENDED - TITLE.
Section 101.1, Title, of the ISPSC is hereby deleted and there is enacted in lieu thereof the following section:
Section 101.1 Title.  These regulations shall be known as the Ankeny Swimming Pool and Spa Code, hereinafter known as “this code.”
183.07 SECTION 103.1 INSERTION - CREATION OF ENFORCEMENT AGENCY.
Section 103.1, Creation of Enforcement Agency, of the ISPSC is hereby modified by inserting the following:

183.08 SECTION 105.4.3 AMENDED - EXPIRATION.  
Section 105.4.3 Expiration, of the ISPSC, is hereby amended by deleting said section and inserting in lieu thereof the following:
Section 105.4.3 Twelve Month Expiration Every permit issued under the provisions of this Code shall expire twelve (12) months from the date of issue, unless the application is accompanied by a construction schedule of specific longer duration, in which instance the permit may be issued for the term of the construction schedule, with approval of the Code Official. If the work has not been completed by the expiration date of the permit, no further work shall be done until the permit shall have been renewed by the owner or his or her agent and by payment of the renewal fee as established by Resolution of the City Council, and provided no changes have been made in plans or location. Upon approval, permits may be extended in accordance with the terms and requirements pursuant to City Council resolution or as the same may be amended by the City Council from time to time.
183.09 SECTION 106.2 AMENDED - RETENTION OF CONSTRUCTION DOCUMENTS.
Section 106.2, Retention of Construction Documents, of the ISPSC, is hereby amended by deleting the last sentence of said paragraph.
183.10 SECTION 108.2 ADDITION - SCHEDULE OF PERMIT FEES.
Section 108.2 Schedule of Permit Fees, of the ISPSC, is hereby amended by adding the following exception:

Persons performing work on exempt projects for the Federal Government, the State, the county or city may obtain permits for such work without paying permit fees described herein: provided, however, that nothing in this section shall be construed to exempt payment of permit fees by persons performing work under the direction of the City of Ankeny in connection with the abatement of property as prescribed by law.
183.11 SECTION 108.4 ADDITION - WORK COMMENCING BEFORE PERMIT ISSUANCE.
Section 108.4, Work commencing before permit issuance, of the ISPSC, is hereby established by adding the following sentence after said sections:
Sections 108.4 Work commencing before permit issuance Said fee shall be 100 percent of the usual permit fee in addition to the required permit fees.
183.12 SECTION 111 AMENDED - -MEANS OF APPEAL.
Section 111, Means of Appeal, of the ISPSC, is hereby amended by deleting said section and inserting in lieu thereof the following:
Section 111 Board of Examiners and Appeals Pursuant to the Ankeny Municipal Code, there is hereby created the Ankeny Board of Examiners and Appeals. Appeals shall be in accordance thereof.
183.13 SECTION 113.4 AMENDED - VIOLATION PENALTIES.
Section 113.4, Violation penalties, of the ISPSC, is hereby amended by deleting said section and inserting in lieu thereof the following:
Section 113.4 Violation penalties Any person who violates a provision of this code or fails to comply with any of the requirements thereof or who erects, installs, alters or repairs a pool or spa in violation of the approved construction documents or directive of the Code Official, or of a permit issued under the provisions of this code, shall be subject to penalties as prescribed by law.
183.14 SECTION 305.1 AMENDED - GENERAL.
Section 305.1, General of the ISPSC, is hereby amended by deleting said section and inserting in lieu thereof the following:
Section 305.1 General The provision of this section shall apply to the design of barriers for restricting entry into areas having pools and spas. Where spas or hot tubs are equipped with a lockable safety cover complying with ASTM F1346, the areas where those spas or hot tubs are located shall not be required to comply with Section 305.2 through 305.7.
