§ 34.50 EXPENDITURE OF PUBLIC FUNDS.
   (A)   Council is hereby established as the purchasing agency (“Purchasing Agency”) for the town with all of the powers and duties of an I.C. 5-22 purchasing agency now and hereafter authorized by applicable authority.
   (B)   The Town Clerk-Treasurer (“Clerk-Treasurer”) is hereby designated as a purchasing agent (“Purchasing Agent”) of that Purchasing Agency as contemplated by I.C. 5-22, and as such is authorized to purchase supplies or services in any transaction where those supplies or services have an estimated cost of less than $500 the open market, without inviting or receiving proposals or bids.
   (C)   The Town Utility Superintendent is hereby also designated as a Purchasing Agent of that Purchasing Agency and as such is authorized to purchase supplies or services on the open market, without inviting or receiving proposals or bids, in any transaction where those supplies or services have an estimated cost of less than $500 and up to $2,500 after consulting with at least one Council Member or the Clerk-Treasurer.
   (D)   The Town Marshal (Police Chief) is hereby also designated as a Purchasing Agent of that Purchasing Agency and as such is authorized to purchase supplies or services on the open market, without inviting or receiving proposals or bids, in any transaction where those supplies or services have an estimated cost of less than $500 and up to $2,500 after consulting with at least one Council Member or the Clerk-Treasurer.
   (E)   The Volunteer Fire Chief is hereby also designated as a Purchasing Agent of that Purchasing Agency and as such is authorized to purchase supplies or services on the open market, without inviting or receiving proposals or bids, in any transaction where those supplies or services have an estimated cost of less than $500 and up to $2,500 after consulting with at least one Council Member or the Clerk-Treasurer.
   (F)   Purchasing rules and/or purchasing policies appropriate in supplementing I.C. 5-22 as it now and hereafter provides shall be adopted, and may thereafter be modified or supplemented, by the Council by resolution and/or ordinance as Council determines from time to time.
   (G)   This section is effective and, to the extent that it conflicts with the provisions of any prior ordinance or resolution of Council, supersedes such provisions as of its adoption and execution, and otherwise in accordance with applicable law and shall be incorporated in and become a part of the Town Code.
