§ 51.02 CROSS-CONNECTION CONTROL AND BACKFLOW PREVENTION.
   (A)   The installation or provision of any cross-connection with the distribution system is prohibited, except as authorized herein.
   (B)   The control or elimination of cross-connections shall be in accordance with the then effective provisions of the Indiana Administrative Code (327 IAC 8-10) and this code. The policies, procedures and criteria for determining appropriate levels of protection shall be in accordance with the IDEM Cross Connection Control & Backflow Prevention Manual: 2013 Edition, as published by the Foundation for Cross-Connection Control and Hydraulic Research, of the University of Southern California, or the then most current superseding edition or amendment of that manual. The materials are incorporated herein by reference and two copies of the materials referenced shall be available for inspection and copying at the Clerk-Treasurer’s Office during normal business hours.
   (C)   The Water Department shall deny or discontinue water service to any user failing to cooperate in the installation, maintenance, testing, or inspection of backflow prevention assemblies.
   (D)   As a condition of new or continued water service, approved backflow prevention assemblies shall be installed, tested, and properly maintained in all customer facilities:
      (1)   Where they exist as of the date of adoption of this provision of the code. (April 10, 2017).
      (2)   Constructed after April 10, 2017, which are designated as a cross-connection hazard by the then effective provisions of 327 IAC 8-10.
      (3)   Where a backflow incident occurs on or after April 10, 2017, which results in a contaminant or a pollutant being introduced into the distribution system.
   (E)   “An approved backflow assembly” means a backflow prevention assembly model approved by the Indiana Department of Environmental Management and the Department. The Department shall maintain a list of approved backflow prevention assemblies. The assembly shall be matched to the degrees of hazard and to the approved installation application.
   (F)   The Department, Water Department, and such staff members as either may designate, are delegated the authority to inspect, approve, and disapprove backflow prevention assemblies for installation, corrections, modifications, repairs, or maintenance on backflow prevention assemblies and to inspect all locations where backflow prevention assemblies may be required. A minimum standard for the maintenance and installation of backflow prevention assemblies shall be those set forth in the IDEM Cross Connection Control & Backflow Prevention Manual: 2013 Edition, as published by the Foundation for Cross-Connection Control and Hydraulic Research, of the University of Southern California, or the then most current superseding edition or amendment of that manual. The Department is authorized to establish higher standards for installation and maintenance of backflow prevention assemblies where it finds that good engineering practice, industry standards or the protection of public health requires such higher standards. Any such higher standards are subject to review and modification by the Board upon written request filed with the town’s Clerk-Treasurer by any interested party. However, pending that review those higher standards shall be enforced if, in the judgment of the Department, the public interest so requires.
   (G)   As a condition of continued water service, a user shall make that user’s premises, including buildings and structures, to which water is supplied, accessible to the Department or Water Department personnel at all reasonable times to determine whether backflow prevention assemblies are required or are properly installed and maintained.
   (H)   The town prohibits interconnection of private water supplies with the distribution system. Auxiliary water supplies (private wells, piped irrigation sources, etc.) are a major cross-connection control hazard and therefore must be effectively isolated from the distribution system.
   (I)   All backflow assemblies shall be tested in accordance with the then effective provisions of 327 IAC 8-10 or more frequently if the Department determines such is required to protect the public health or water quality. The assembly shall be tested in accordance with the IDEM Cross Connection Control & Backflow Prevention Manual: 2013 Edition, as published by the Foundation for Cross-Connection Control and Hydraulic Research, of the University of Southern California, or the then most current superseding edition or amendment of said manual. All backflow prevention assemblies shall have additional tests performed to determine the overall soundness of the backflow preventer. The additional tests shall be conducted in accordance with then current written procedures in the Department.
   (J)   The gauge used to test backflow prevention assemblies shall be certified as to accuracy by the gauge manufacturer on an annual basis. It is the responsibility of the certified backflow prevention device tester to obtain and show proof of the accuracy of each gauge annually.
   (K)   A Cross Connection Control Device Inspector, as defined in 327 IAC 8-10-1, as amended, includes a private inspector hired by the town or user for this purpose.
   (L)   All test reports shall be submitted on a test report form to the Department.
   (M)   The user shall bear all costs of installation, testing, and maintenance, together with all other charges associated with backflow prevention assemblies.
