§ 53.02 RULES, REGULATIONS AND OPERATION.
   (A)   Trash collection in the town shall be done by a private company and contracted for by the Town Council.
   (B)   All trash shall be collected from all active collection units within the town once per week. However, no collection shall be made on Sundays, or on the following holidays: July 4th, Thanksgiving Day, Christmas Day, and New Year’s Day. If a regularly scheduled trash pick-up should fall on the above holiday, trash collection shall be provided on a one day delayed schedule.
   (C)   Trash pickup will be for no more than will fit inside the 95 gallon waste cart with the lid closed per dwelling per week. Residents will be required to bag all trash placed in the waste cart provided by the contractor.
   (D)   Lawn cuttings, shrubbery, trees and tree trimmings will not be accepted.
   (E)   All governmental, business, professional and residential garbage and rubbish to be collected pursuant to this chapter shall be placed for collection by the owners or producers thereof in approved bundles or approved containers which shall then be placed conveniently for the collection at ground level, within five feet adjoining an improved and passable alley, or if there is not an alley at an easily accessible spot within five feet of the front curb line at times and on collection days to be established by the town.
   (F)   Approved bundles and approved containers shall not be placed for collection earlier than 5:00 p.m. on the day prior to the collection day established by the town.
   (G)   Approved containers shall not remain at the collection point after 9:00 p.m. on the day of collection.
   (H)   No person shall convey or haul over the streets, alleys or public places of the town any garbage or rubbish unless the vehicle containing it has a box bottom with tight-fitting ends, sides and bottom, property closed and tight-fitting, and covered with a lid, screen, wire mesh, tarpaulin or other cover which is sufficient to prevent its contents from falling or blowing upon the streets, alleys or other public or private property.
   (I)   No persons shall burn or cause any material to be burned in the open air outside of the dwelling house or other building within the town limits unless the material so burned is burned in an Environmental Protection Agency or State Department of Environmental Management approved incinerator of a type and construction as shall prevent any ashes or embers from flying or scattering and becoming a hazard and endangering surrounding property.
