§ 52.080 RATES AND CHARGES.
   (A)   Tap charges. Each customer location at the time of initial connection with the wastewater works system shall pay a tap charge to cover the costs of excavating and tapping the main and furnishing and installing service pipe from the main to the lot line. The tap charge for up to and including a three quarter inch tap shall be $1,500. The charge for a larger than a three-quarter inch tap shall be the town’s cost of labor, materials, power machinery, transportation and overheard incurred for installing the tap, but not less than $1,500.
   (B)   Monthly billing period charges.
      (1)   Each wastewater customer shall be charged $11.29 per 1,000 gallons of metered water usage each monthly billing period, plus a monthly base charge in accordance with the following:

      (2)   Those wastewater customers which are parties to a particular negotiated wastewater collection and/or processing contract shall pay as follows:
         (a)   Norwood Regional Water and Sewer District. The initial sentence of paragraph 1.03 of its Wastewater Service Agreement shall now, and hereafter provide that the town will charge and collect from that District a treatment fee for wastewater treatment service of $11.29 per 1,000 gallons of wastewater processed by the town’s wastewater treatment plant. (This contracted monthly volume charge is 16.4% greater than the wastewater utility’s non-contracted monthly volume charge.)
         (b)   Other. None.
   (C)   Collection and deferred payments charge.
      (1)   All delinquent fees and charges will be assessed a late charge of 10% in accordance with applicable law and may be collected as provided by applicable law.
      (2)   Delinquent fees and charges shall be assessed against real property and constitutes a lien against that property. The lien is superior to all other liens except tax liens. Except as provided in division (C)(2) and (3), the lien attaches when notice of the lien is filed in the county recorder’s office under I.C. 36-9-23-33.
      (3)   In the event a service address is occupied by someone other than the owner, the delinquent fees and charges shall be assessed against real property and constitute a lien against the property only if the utility notifies the owner not later than 20 days after the time the utility fees become 60 days delinquent. A notice sent to the owner under this subsection must be sent by first class mail or by certified mail, return receipt requested (or an equivalent service permitted under I.C. 1-1-7-1) to: (i) the owner of record of real property with a single owner; or (ii) at least one of the owners of real property with multiple owners; at the last address of the owner for the property as indicated in the records of the county auditor on the date of the notice of the delinquency, or to another address specified by the owner, in a written notice to the utility, at which the owner requests to receive a notice of delinquency under this subsection. The cost of sending notice under this subsection is an administrative cost that may be billed to the owner.
   (D)   Hauled wastewater fee. Wastewater received in accordance with § 52.066 shall be billed at $75 per 1,000 gallons.
   (E)   Returned check charge. $30.
