The City Water Department, hereinafter sometimes referred to as the “utility,” is hereby granted, subject to the terms and conditions hereof, the franchise right and privilege to erect, construct, maintain, and operate a domestic water system within the corporate limits of the City, herein sometimes referred to as the “City,” as the same now exist or may be hereafter constituted; and the franchise right and privilege to construct, erect, operate, and maintain its facilities, in, upon, along, across, above, over, and under the streets, alleys, and public ways now laid out or dedicated, and all extensions thereof, and additions thereto, for the provision of water services in the City.
