§ 51.22 DAMAGING THE WATER SYSTEM PROHIBITED; RIGHT TO SHUT OFF WATER FOR NONPAYMENT.
   (A)   A water account holder shall be subject to a Class 2 fine for any manipulation, tampering or modification of a City-installed water transmission line or water meter to alter its read by any entity or individual other than a City employee, an entity or individual authorized by the City, or law enforcement or a firefighter responding to a call for service.
   (B)   The City shall utilize whatever lock, restrictor, clamp or other device it deems necessary to shut off the flow of water to any user of the water system for nonpayment of bills after notice and meaningful opportunity to be heard on disputed bills. Removal of a city device that shuts off water is prohibited unless performed by a City employee, an entity or individual authorized by the City, or law enforcement or a firefighter responding to a call for service.
   (C)   A water account holder shall be subject to a Class 2 fine for the removal of any City-installed device as established in division (B) upon a water meter to shut off the flow of water, if done by any entity or individual other than a City employee, an entity or individual authorized by the City, or law enforcement or a firefighter responding to a call for service.
   (D)   A water account holder, entity or individual, other than a City employee, an entity or individual authorized by the City, or law enforcement or a firefighter responding to a call for service, shall be subject to a Class 1 fine should that water account holder, entity or individual in any manner pipe around a water meter or otherwise divert water from the system except through approved outlets.
   (E)   The water account holder shall be solely liable for any damage caused to a City water meter or other city property or equipment by the account holder, or his or her tenants or agents, due to actions established in divisions (A), (C) and (D). Liability shall include the full replacement cost of a new water meter and all the costs to repair the damage to City property or equipment. Damage determination and cost assessments will be conducted and made available by Amity Public Works.
   (F)   The City will include the information provided in this section and in § 51.99 (C) in the agreement provided to the water user at the time of application.
