909.01 PERMIT REQUIRED.
   Any person, firm, corporation or other who desires to install any utility or other infrastructure within any public right-of-way located within the City of Amherst shall first apply for, and obtain from the Mayor, a permit therefor. As part of such application, the applicant shall provide the following:
   (a)   Detailed design drawings of the proposed improvements, prepared by a professional engineer and/or registered surveyor showing existing topography and utilities, horizontal and vertical locations of the proposed facility, details of areas of potential conflict with existing utilities; and,
   (b)   A description of the method of public concrete/asphalt flatwork crossings if any, (i.e., open-ended excavation, directional drilling, horizontal bore, etc.); and,
   (c)   Details for concrete/asphalt replacement and repair together with an estimate for the replacement/repair limits; and,
   (d)   Plans for traffic maintenance during construction of the facility; and,
   (e)   A signed Right-of-Way Use Agreement, as provided by the City of Amherst, which includes, but is not limited to, acknowledgement that the City of Amherst shall not be responsible for any damage or repair/restoration of the applicant's facilities located within the right-of-way; agreement to relocate the facility, at the applicant's expense, when accommodation for future roadways and/or other infrastructure improvement is deemed by the City to be necessary; acknowledgment of applicant's responsibility for the repair/replacement of other utilities encountered and/or damaged during the course of the project; agreement to hold the City harmless for any damage, or damage claims of others, arising or resulting from the installation of the facility; agreement for the proper repair/restoration, at no cost to the City, of areas associated with the installation of the facility, including but not limited to tree lawn grading/topsoil replacement, seeding and straw placement, sidewalks, driveway and street pavement/curb and gutter repair/replacement; and, proof of liability insurance, naming the City of Amherst as an additional insured, in the amounts listed within the Right-of-Way Use Agreement, during and for all work to be completed in connection with the project.
