§ 93.04 REMOVAL OF A SIDEWALK.
   (A)   Removal of a sidewalk not designated on the master sidewalk plan, without replacement, shall occur only by the following.
      (1)   The owner of the abutting property shall petition the City Council and the City Council shall determine by resolution that it is in the interest of the public to remove the sidewalk without replacing it. Removal of the sidewalk in this case shall be at the property owners’ expense.
      (2)   The City Council on its own motion, may also seek the removal of sidewalk without replacement by resolution and the motion must pass by a 4/5 vote. The city pays for removal of the sidewalk in this case.
   (B)   No person or persons, firm or corporation shall remove a public sidewalk, or any section thereof, within the corporate limits of the municipality without the written consent of the City Council.
