7-12-6: IMPOUNDMENT:
   A.   Animals Impounded: The following may be taken by police or the animal control officer, by humane means, whether found upon public or private property, and impounded in an animal shelter and there confined in a humane manner:
      1.   Unrestrained dogs;
      2.   Cats becoming a public nuisance, as defined in subsections 7-12-2C and 7-12-8B of this chapter;
      3.   Any female dog or cat in heat not confined in a building or secure enclosure in such manner that such female dog or cat cannot come into contact with another animal except for planned breeding purposes.
   B.   Notice Of Impoundment; Disposition: Impounded dogs and cats shall be kept for not less than five (5) days unless reclaimed by their owner or retrieved by their caretaker. If the owner or caretaker can be identified, the animal control officer shall immediately, upon impoundment, notify the owner or caretaker by telephone or mail of the impoundment of the animal. Dogs and cats not claimed by their owners or caretakers within five (5) days, or placed in suitable new homes, may be humanely euthanized by an agency delegated by proper officers of the city to exercise that authority. Healthy community cats that have been impounded may be adopted, without adherence to the aforementioned holding period. Notwithstanding the foregoing, whenever a community cat is visibly injured or diseased and appears to be suffering and it reasonably appears that such cat cannot be expeditiously cured and returned to field, transferred to a humane society or private animal nonprofit organization or placed in foster care, then the police department or animal control officer, acting in good faith and upon reasonable belief, may humanely euthanize the community cat.
   C.   Impoundment Fee: Any owner reclaiming an impounded animal shall pay a fee of forty dollars ($40.00) to defray the cost of impounding said animal, plus an additional fifteen dollars ($15.00) for each day or any portion of a day that the animal has been impounded before being reclaimed.
Where a particular animal is impounded for a second occasion, the owners reclaiming the impounded animal shall pay a fee of seventy five dollars ($75.00) plus fifteen dollars ($15.00) for each day or any portion of a day that the animal has been impounded before being reclaimed.
On third and subsequent occasions, the owner reclaiming the impounded animal shall pay a fee of one hundred dollars ($100.00) plus fifteen dollars ($15.00) for each day or any portion of a day that the animal has been impounded before being reclaimed.
All fees provided to be paid by this section shall be paid to the city treasurer. The owner may also be proceeded against for violation of this section. (Ord. 7513, 4-27-2016)
