§ 6.26.130 CONSEQUENCE OF AN UNTIMELY APPEAL.
   (A)   If a timely appeal and/or payment of the appeal fee is not received by the City Clerk, the right to appeal is waived and the notice of abatement is final and binding. In such instances, the City may, without any administrative hearing, cause the abatement with City personnel of any or all of the nuisance conditions or activities stated in the notice of abatement. The City shall follow the procedures stated in this chapter for recovery of all abatement costs, fees and expenses (incidental or otherwise).
   (B)   Nothing contained in this chapter shall obligate the City to undertake abatement actions pursuant to a notice of abatement, whether or not there is a timely appeal.
