(A) Except as otherwise provided by state law, every city officer, except the Mayor and the members of the Common Council, shall execute a bond to the approval of the Mayor, payable to the city, in a penal sum as the Council may enact by ordinance in accordance with I.C. 5-4-1-18, conditioned for the faithful performance of the duties of the office. The bond shall be filed with the Clerk-Treasurer.

(B) Except as otherwise provided by state law, every city officer shall, before entering upon the duties of his or her office, take and subscribe an oath, to be endorsed on his or her certificate of election or appointment, before the Clerk-Treasurer or some other officer authorized to administer oaths that he or she will support the Constitution of the United States and the state’s Constitution and will faithfully discharge all official duties. This oath shall be filed with the Clerk-Treasurer.

(C) Except as otherwise provided by state law, any city officer who does not file the required oath and/or bond within ten days after the beginning of the term for which that officer was elected or appointed shall be deemed to have refused to serve, and the office shall be deemed to be vacant.
