§ 90.085 CONFINEMENT AND RESTRAINT.
   (A)   A vicious animal is unconfined if the animal is not securely confined indoors or confined in a secure, enclosed, locked pen or structure upon the premises of the owner of the animal. The pen structure must have secure sides and a secure top attached to the sides. If the structure has no bottom secured to the sides, sides must be embedded into the ground not less than one foot. All such pen structures must be adequately lined and kept in a clean, sanitary condition. All such pens or structures must conform to any applicable provisions of the City Building Code and/or the State Building Code, being 675 I.A.C. 13.
   (B)   The owner of the vicious animal shall display, in a prominent place on his or her premises, a clearly visible warning sign indicating the presence of the vicious animal on the premises. Similar signs shall be required to be posted on the pen or kennel of the animal. These postings must be approved by the animal control officer.
