§ 90.063 ADDITIONAL PERMIT FEES.
   (A)   In addition to the fees set forth in § 90.062(B)(1), fees for other permits shall be based on current state-approved amounts and/or as set by City Council from time to time as follows:
      (1)   Each pet shop;
      (2)   Each auction;
      (3)   Each zoological park;
      (4)   Each circus;
      (5)   Each performing-animal exhibition; and
      (6)   Each grooming shop.
   (B)   No fee shall be required of any veterinary hospital, the AAS, or other government- operated zoological park or laboratory.
   (C)   (1)   It shall be unlawful for any person to establish, operate, or maintain any of the uses for which a fee is imposed by this chapter without first having obtained a permit as herein provided. An application for a permit shall be obtained from the City Clerk-Treasurer, and such application, having set forth in number, breed, color, and sex of each animal held at the location in the city at which such animals will be housed, shall be submitted to the ACO. In no event shall any of the uses controlled by this subchapter be construed as a home occupational use, as defined, and may be permitted and continued only as permitted by the city zoning ordinances.
      (2)   The City Clerk-Treasurer shall forward any acceptable application to the ACO/ACF following appropriate investigation. Approval or disapproval of the application shall rest with the ACO. In making his or her decision, the ACO shall make certain there will be no violation of city provisions or state, county, or federal laws and shall determine that, in general, the presence of a kennel will not endanger the peace and tranquility of the city.
      (3)   Once approved by the ACO, a permit shall be issued to the applicant(s) by the Clerk-Treasurer according to the provisions of this subchapter. The permit may, at any time, be revoked by the ACO or Common Council if there is a violation of any applicable city ordinance or clear and present evidence of mistreatment of animals or determination of the deterioration of physical facilities. Provided however, reasonable discipline of animals in their training shall not be construed as mistreatment.
      (4)   Any person who has a change in the category under which a permit was issued shall be subject to reclassification, and appropriate adjustments of the permit fee shall be made.
