§ 70.23 TRAFFIC ACCIDENT STUDIES AND REPORTS.
   (A)   Studies. Whenever accidents at any particular location become numerous, the Police Department shall cooperate with city officials in conducting studies of such accidents and determining remedial measures.

   (B)   Traffic accident reports. The Police Department shall maintain a suitable system of filing traffic accident reports. Accident reports or cards referring to them shall be filed alphabetically by location. These reports shall be available for the use and information of city officials and in accordance with I.C. 9-26-2-3.

   (C)   Written report of accident.
      (1)   The city requires that the driver of a vehicle involved in an accident also file with the Police Department a report of that accident or a copy of any report required by I.C. 9-26-2-2 to be filed with the State Police Department. This division (C)(1) shall not apply if the driver was present at the scene of the accident during the investigation by the Chief of Police or any other police officer.
      (2)   If the driver is not the owner of the vehicle and is physically unable to file the report required by division (C)(1) above, the owner of the vehicle shall file this report within five days after learning of the accident.
      (3)   All written accident reports made by drivers, owners, or occupants of vehicles involved in accidents, as required in divisions (C)(1) and (2) above, shall be without prejudice to the individual so reporting and shall be for the confidential use of the Chief of Police or other governmental agencies having use of the records for accident prevention purposes.
         (a)   However, the Chief of Police may disclose the identity of a person involved in an accident when such identity is not otherwise known or when that person denies his or her presence at that accident.
         (b)   No report shall be used as evidence in any trial, civil or criminal, arising out of any accident except that the Chief of Police shall furnish said report, upon demand of any person who has or claims to have made a report, solely to prove a compliance or a failure to comply with the requirements that a report be made to the Police Department or as required by I.C. 9-26-3-4.
