§ 54.03 FUNDING.
   (A)   Stormwater service charges. All owners of real property in the city shall be charged for the use of the city’s stormwater system based on the amount of stormwater and rate of flow of stormwater which is determined to be entering the stormwater system from the average residential property in the city. The impact of the stormwater from the property on the system shall be determined on the basis of the flat rates or the measurements contained in this chapter.
   (B)   Stormwater user fee determination.
      (1)   The monthly stormwater utility user fee is uniform for all residential properties assigned one ERU. The user fee for one ERU shall be based on current state-approved amounts and/or as set by City Council from time to time. This user fee may be changed annually or from time to time by the Common Council by ordinance in compliance with applicable law.
      (2)   The monthly stormwater utility user fee for a nonresidential property or a multi- family property with five or more units, defined as nonresidential, are determined by measuring the actual impervious surface of the property and dividing it by one ERU base rate or 2,750 square feet. No single property shall exceed 60 ERUs. This method allows for the nonresidential property user fees to be based upon the amount of impervious surface area within the property as compared to the amount of impervious surface area of the average residential property. For example, a nonresidential property with 30,000 square feet of impervious surface shall have a user fee of 10.9 times the base rate. The ERU multiplier shall be rounded to one decimal place and the minimum ERU shall be one. The ERU multiplier is then multiplied by the current fee for one ERU in order to determine the actual user fee in dollars.
      (3)   Impervious surface areas shall be measured in the field or based on aerial footprint of impervious surfaces. Angled rooftops shall be measured as if they were flat. All impervious surfaces within the parcel boundaries of a property shall be measured with the exception of those surfaces located within a road right-of-way. For multi-unit properties, all units within a single parcel and all impervious surfaces, such as parking lots and walkways, shall be measured and billed to the property owner. For multi-level or multi-story structures containing more than one level, the footprint of the building and other impervious surfaces shall be measured and billed to the property owner.
      (4)   A reduction in the stormwater user fee, or credit, based on specific qualifying conditions may be available to utility rate payers. Utility rate payers must successfully complete any application process required by the Board of Public Works and Safety to demonstrate compliance with this section. Credit requirements and procedures shall be established by the Board of Public Works and Safety or subsequently established Stormwater Utility Board. Upon written notice, the Stormwater Utility Board may revoke a credit for good reason including failure to meet credit conditions.
