   (B)   Penalty.
      (1)   The penalty for violation of any weight provision of the city shall be in accordance with the fine schedule set forth in KRS 189.990(2).
      (2)   (a)   Any violation of the through-truck traffic prohibition for Poplar Ridge Road is hereby classified as a civil offense pursuant to KRS 65.8808 and subchapter 35.60 et seq. and such classification is intended, and shall be construed, to provide an additional or supplemental means of obtaining compliance with this provision, and nothing contained herein, or in subchapter 35.60 et seq shall prohibit the enforcement of this section by any other means authorized by law.
         (b)   If a citation for a violation of this provision is not contested by the person charged with the violation, the civil fine to be imposed for each offense shall be ten dollars ($10.00) for the first offense, one hundred dollars ($100.00) for the second offense, and two hundred dollars ($200.00) for the third, and thereafter, offense.
         (c)   If a citation is contested and a hearing before the Code Enforcement Board is required, the maximum civil fine which may be imposed at the discretion of the Board shall be from ten dollars ($10.00) to twenty-five dollars ($25.00) for the first offense; from twenty-six dollars ($26.00) to one hundred dollars ($100.00) for the second offense; and from one hundred and one dollars ($101.00) to two hundred dollars ($200.00) for the third, and thereafter, offense.
   (C)   Each violation of the provisions regarding Poplar Ridge Road shall be considered a separate fineable offense for which a separate citation shall be issued.
