§ 91.26  DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BARBEQUE GRILLS.  Includes the devices sometimes commonly referred to as hibachi, grill, smoker or gas grill, utilizing charcoal, propane, natural gas or wood pellets as a fuel for outdoor cooking and, although fire may not be within a fully enclosed firebox, the use thereof shall not constitute open burning.
   CHIMNEAS. Outdoor patio fireplaces, usually made from clay, intended to confine and control outdoor wood fires.
   FIRE PIT.  A freestanding vessel designed and intended to confine and control outdoor wood fires, constructed above ground of steel, concrete and/or stone with a heavy steel screen cover.
   GOVERNING BODY.  The Alda Village Board of Trustees.
   OPEN BURNING.  Using fire to burn material which is not contained within a fully enclosed firebox or structure and from which the products of combustion are permitted directly to the open atmosphere without passing through an appropriate stack, duct or chimney.
   OUTDOOR FIREPLACES.  Includes fire pits and chimineas. These residential outdoor fireplaces use wood as a fuel and are used for containing recreational fires located at a private residence for the purpose of outdoor cooking and personal enjoyment. OUTDOOR FIREPLACES do not include barbeque grills.
   OUTDOOR HEATER.  A device designed for generation of radiant heat for outdoor use through the combustion of clean-burning fuels such as propane or natural gas.
   VILLAGE.  The Village of Alda, Nebraska, a municipal corporation.
