§ 70.99  PENALTY.
   (A)   Any person who shall violate or refuse to comply with the enforcement of any of the provisions of this chapter, set forth at full length herein or incorporated by reference shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be fined not more than $100 for each offense. A new violation shall be deemed to have been committed every 24 hours of such failure to comply.

   (B)   (1)   A person violating any provision of § 70.48(A) shall be guilty of an infraction as defined in Neb. RS 29-431 and shall be fined $25 for each violation, it being deemed that the failure to provide a child restraint system for more than one child in the same vehicle at the same time, as required in § 70.48(A), shall not be treated as a separate offense. Further, any person who is charged with a violation of § 70.48(A) who does not have in his or her possession a child restraint system meeting the requirements of Federal Motor Vehicle Safety Standard 213 as of August 26, 1983, and who subsequently purchases or rent for a one-year period such a system prior to his or her court appearance, shall, upon presentation of proof of purchase or proof of rental for a one-year period of such a system, be able to utilize such presentation as an absolute defense and cause for dismissal of such charge.
      (2)   A person who has acquired the statement authorized by § 70.48(B), but fails to show an officer such statement when requested to do so, shall be guilty of an infraction as defined in Neb. RS 29-431 and shall be fined $10 for each offense, it being deemed that the failure to produce a statement for more than one child in the same vehicle at the same time not be treated as a separate offense.
