ORDINANCE NUMBER 2009-06
AN ORDINANCE ENACTING AND ADOPTING SUPPLEMENT TWO UPDATES TO THE CODE OF ORDINANCES FOR THE TOWN OF ALBION, INDIANA, UPDATING LOCAL LEGISLATION CURRENT THROUGH ORDINANCE 2009-04, PASSED APRIL 28, 2009 AND STATE LEGISLATION CURRENT THROUGH THE 2008 PAMPHLET #6.
WHEREAS, continuous Codification updates of general and permanent ordinances for the Town of Albion are necessary for the complete preservation of the public peace, health, safety and general welfare of the municipality and for the proper conduct of its affairs; and
WHEREAS, the Acts of the Legislature of the State of Indiana empower and authorize the Town of Albion to revise, amend, restate, codify and compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate such ordinances into one ordinance in book form; and
WHEREAS, on the 15th day of January, 2008, the Albion Town Council adopted the 2007 Code of Ordinances for the Town of Albion as completed by American Legal Publishing Corporation of Cincinnati, Ohio consisting of a book form containing all ordinances of general and permanent nature previously enacted by the Albion Town Council; and
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF ALBION:
Section 1:   The general ordinances of the Town of Albion are codified and compiled in book form known as “Town of Albion, Indiana Code of Ordinances” adopted as Ordinance 2008-02 on January 15, 2008 and containing local legislation current through Ordinance 2007-08, passed May 22, 2007 and state legislation current through 2007 Pamphlet #6.
Section 2:   Such Code of Ordinances as adopted consists of the following: Title I: General Provisions; Title III: Administration; Title V: Public Works; Title VII: Traffic Code; Title IX: General Regulations; Title XI: Business Regulations; Title XIII: General Offenses; Title XV: Land Usage; and a Table of Special Ordinances and Parallel References.
Section 3:   Passage of this Ordinance updates the Code of Ordinances with local legislation current through Ordinance 2009-04, passed April 28, 2009 and state legislation current through 2008 Pamphlet #6.
Section 4:   Such Code remains in full force and effect from the date of adoption and such amendments to the Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded, and approved and that any public hearings and notices thereof as required by law have been given.
