§ 31.12 DUTIES AND RESPONSIBILITIES.
   (A)   The Town Manager's job description, as set forth in this section, shall henceforth outline the powers and duties, pursuant to I.C. 36-5-5-8 as amended.
      (1)   Upon appointment, the Town Manager shall execute and maintain a bond in accordance with I.C. 36-5-5-5 and I.C. 5-4-1.
      (2)   The Town Manager shall not issue or execute bonds, notes or warrants of the town.
      (3)   The Town Manager shall be under the direction of the Town Council and shall be responsible for the administrative duties of the Town Council, which said duties shall generally consist of the following:
         (a)   Attend the meetings of the Town Council and recommend actions he or she considers advisable.
         (b)   Shall hire, subject to the final approval of the Town Council, employees according to the pay scales and standards fixed by the Town Council or by statute.
         (c)   Shall suspend, discharge, remove, or transfer town employees, if necessary, for the welfare of the town in accordance with the town's personnel policy.
         (d)   May delegate any of his or her duties to an employee responsible to him or her.
         (e)   Shall administer and oversee the enforcement of all ordinances, orders, and resolutions of the Town Council.
         (f)   Shall see that all statutes that are required to be administered by the Town Council or a town officer subject to the control of the Town Council are faithfully administered.
         (g)   Shall work with department heads and the Clerk-Treasurer in the budget process and shall present to the Council recommendations for a balanced budget for the upcoming year. The Town Manager shall furthermore attend, with the Clerk-Treasurer, all required hearings and/or workshops relating to the budget process.
         (h)   Shall execute contracts on behalf of the town for materials, supplies, services, or improvements after the completion of the appropriations, notice, and competitive bidding required by statute.
         (i)   May receive service of summons on behalf of the town.
         (j)   Serve as the staff to the Town Council. Research issues and policies as directed by the Town Council. Suggest to the Town Council ways to improve service delivery to the tax payers with an emphasis on savings in the delivery of said services. Suggest better, more efficient ways of conducting business. Work with the department heads to assist in the resolution of issues. Set up meeting room prior to meetings.
         (k)   Insure the policies and directives of the Town Council are followed.
         (l)   Maintain board appointment lists and advise the Council President and/or the appropriate appointing authority of any vacancies or reappointments needed. Ascertain and interview potential candidates for said appointments at the direction of the Council President and/or the appropriate appointing authority.
         (m)   Maintain and revise 5, 10, and 15 year capital and equipment plans.
         (n)   Supervise, review, and monitor adequate and proper insurance coverage for town buildings, equipment and liabilities including but not limited to:
            1.   Liability;
            2.   Auto;
            3.   Property;
            4.   Boiler & Machinery;
            5.   Inland Marine;
            6.   Contractors;
            7.   Health; and
            8.   Workmen's Compensation Insurance;
         (o)   Oversee the Albion Sidewalk Program.
         (p)   Oversee and update the CEDIT Plan of the town.
         (q)   Work with the Utility Supervisor and the Town Engineer on CSO compliance.
         (r)   Oversee OSHA's plans, logs, and confirm compliance with OSHA's plans.
         (s)   Finally, the Town Manager shall have immediate authority and responsibility with regard to the following items:
            1.   Research and investigate, through interaction with the state and special agencies, to aid in the acquisition of available grants to promote the continued growth of the town, including but not limited to IDEM, INDOT, DNR, IACT, Region 3-A, and Indiana Northeast Development.
            2.   Aid department heads by listening to matters brought by citizens in an attempt to resolve those matters with the department head, if possible, prior to a Council meeting or present them to the Town Council for review.
            3.   Report in writing the activities of the Town Manager to the Town Council at its regular meeting.
            4.   To perform such other responsibilities as the Town Council shall designate.
      (4)   The Town Manager shall not:
         (a)   Serve as a member of any body that hears disciplinary charges against the Town Marshal or a member of the town's Police Department.
         (b)   Enter into or bind the town to any contract, without the prior approval of the Town Council.
         (c)   Enter into or bind the town to any grant agreement, without the prior approval of the Town Council.
         (d)   Negotiate for the extension of any utility line beyond the corporate limits without the prior approval of the Town Council.
         (e)   Present to the Town Council any ordinance, other than routine zoning ordinances, which have not been approved in writing by, or drafted by, the Town Attorney.
      (5)   The Town Manager shall attend the meetings of the Town Council and any other meetings required by the town, including but not limited to: Plan Commission Meetings, Board of Zoning Appeals Meetings, Park Department Meetings, Redevelopment Commission Meetings, and Economic Development Commission Meetings.
      (6)   The Town Manager shall be responsible, in connection with his or her service to said boards and commissions for the following:
         (a)   Issuance of building permits, maintain permit computer files with inspections, issue certificates of occupancy, and fax permits to the County Building Department.
         (b)   Processing subdivision documentation, and supervising the town's role in the subdivision process, including Exempt I and Exempt II Divisions.
         (c)   Serve as staff for the Plan Commission, and in that capacity assist in agenda preparation, notification, minute preparation, preparation of staff reports as directed, prepare amendments for the Zoning Ordinance and the Subdivision Ordinance as directed by the Plan Commission, and physically set up the room for the meetings for the Plan Commission, and maintain a membership list of the Plan Commission.
         (d)   Answer citizen zoning, land use, subdivision and street and alley vacation questions. Maintain a map of the town's boundaries including annexations. Supervise acquisition of easements, and street dedications.
         (e)   Serve as the staff for the Board of Zoning Appeals. Prepare agendas, minutes and statutorily required findings of fact needed by the Board of Zoning Appeals for the matters under its consideration, provide notification per I.C. 5-3-1 as amended from time to time; maintain membership lists of the Board of Zoning Appeals, and set up the meeting room prior to the meeting of the Board of Zoning Appeals.
         (f)   Serve as staff for the Redevelopment Commission. In that capacity the Town Manager shall prepare agendas, prepare minutes, provide notification per I.C. 5-3-1 as from time to time amended, prepare financial reports requested by the Redevelopment Commission, prepare and update the ten year plan of the Redevelopment Commission, maintain the membership list of the Redevelopment Commission and set up the meeting room prior to meetings of the Redevelopment Commission.
         (g)   Serve as the staff for the Economic Development Commission. Prepare agendas and minutes, and provide any notification required by statute prior to said meetings, prepare the financial reports requested by the Economic Development Commission and maintain the membership lists of the Economic Development Commission, and set up the meeting room prior to meetings.
      (7)   Reviews. The Town Manager shall be given a performance review at the following intervals:
         (a)   Three months after the initial employment date;
         (b)   Six months after the initial employment date; and
         (c)   Annually thereafter on the anniversary date of the initial employment date.
   (B)   The organization chart, attached to Ordinance No. 2003-08, passed September 23, 2003, is hereby adopted as if fully set forth herein, as the organizational chart for the town.
