§ 150.67 OWNERS; RESPONSIBILITIES.
   (A)   Compliance by owner required.
      (1)   It shall be the duty of the owner of every dwelling to place and maintain the same in a condition as will fully comply with the provisions of this chapter.
      (2)   Upon the failure of any owner of any dwelling to place and maintain the same in condition to fully comply with this chapter, he or she shall be subject to the penalties provided by law.

   (B)   Cleanliness. Every dwelling and every part thereof shall be kept clean and free from any accumulation of dirt, filth, rubbish, garbage, or other matter deleterious to health or constituting a fire hazard, and from vermin and rodent infestation. (`76 Code, § 6-17)
   (C)   Repairs. Every dwelling shall be kept in good repair so as to be fit for human habitation, including but not limited to, entrances, exits, foundation walls, sheds, outhouses, and garages. (`76 Code, § 6-18)
   (D)   Roofs. Every dwelling shall be maintained so that its roof does not leak and so that all running water is drained and conveyed therefrom. (`76 Code, § 6-19)
   (E)   Drainage from roofs. Every dwelling, where necessary to prevent dampness or other damage to or in its walls or ceilings or to buildings on adjoining property, from running water from roofs, shall drain or convey the water into roof gutters or eave troughs, which are connected to downspouts which drain into a storm sewer, if a storm sewer is available and permission is first obtained from the Town Council.    (F)   Foundations. All dwellings, except trailers, must have adequate masonry foundations with suitable cement or wood floors constructed thereon. (`76 Code, § 6-21)
   (G)   Basements. The basement or cellar of every dwelling shall be drained and ventilated and kept free from rubbish accumulation and rodent infestation. (`76 Code, § 6-22)
   (H)   Heating. Every dwelling and/or dwelling unit shall be weatherproof and capable of being heated to a temperature of 70°F in zero weather, and have heating equipment therein which shall be maintained in good order and repair. (`76 Code, § 6-23)
   (I)   Lighting and ventilation.
      (1)   Every dwelling and/or dwelling unit shall contain at least one window which opens directly to the outside air, and the total area of which is not less than 10% of the floor area of the dwelling or dwelling unit.
      (2)   Each window shall be glazed and provided with hardware to conveniently open and securely close the same, and shall be made to open to the extent of not less than 4% of the floor area of the room, unless provision for equivalent ventilation is otherwise made.

   (J)   Screening of windows and doorways. The windows and the outside doorways of every dwelling and/or dwelling unit which are used for ventilation purposes shall be fully screened by metal or plastic screen wire which is not less than 16 meshes to the square inch. (`76 Code, § 6-25)
   (K)   Entrances and exits. There shall be provided for each dwelling unit a separate and direct access therefrom, either to a hallway, landing, stairway, or the outside of the building, and, in the case of a basement dwelling unit, two means of access, one of which shall be directly to the outside of the dwelling, and the other directly to a hallway leading directly to the outside of the dwelling.    (L)   Sleeping quarters. No part of a dwelling unit except a habitable room shall be used for sleeping purposes. (`76 Code, § 6-27)
   (M)   Overcrowding. The total of all habitable rooms in a dwelling unit shall be such as to provide at least 75 square feet of floor area to each occupant who is 12 years of age or over, and at least 40 square feet of floor area for each occupant who is under 12 years of age. (`76 Code, § 6-28)
   (N)   Plumbing. All plumbing, water closets, and other plumbing fixtures in every dwelling and/or dwelling unit shall be maintained in good operating order and repair. (`76 Code, § 6-29)
   (O)   Water supplies and sinks required. Whenever a city water main is located in a street, alley, or easement which abuts the property upon which a dwelling is located, there shall be provided to every dwelling unit therein running water and at least one sink connected to the public sewer or to a water disposal system which meets state standards and conforms to the other requirements of this code.    (P)   Lighting and ventilation of toilets and bathrooms. Every toilet and every bathroom in a dwelling shall be provided with adequate light and ventilation. (`76 Code, § 6-31)
   (Q)   Basement dwelling units. No room in any basement or cellar shall be occupied by anyone or permitted by the owner thereof to be so occupied as a habitable room unless, in addition to all other applicable provisions of this chapter:
      (1)   Its clear inner height is at least seven feet;
      (2)   The uppermost two feet of the required inner height is above the average outside ground level of the dwelling, unless air and light are available through the use of window wells;
      (3)   The floor and walls are waterproof and dampproof, if in contact with earth; and
      (4)   The central heating plant of the dwelling in which it is located is separated from it by a one-hour fire resistive material.

   (R)   Yards. All courts, yards, or other areas on the premises outside of every dwelling shall be drained so as to prevent the accumulation of surface water, and shall be kept free from rubbish, garbage, or other matter deleterious to health or constituting a fire hazard, and from rodent infestation.
