(A) The Chief of the town Fire Department or a designated officer of the Fire Department may, in his or her discretion, impose any reasonable restrictions on open burning by permit, which are necessary to prevent the creation of a nuisance or hazard to the public.
(B) The President of the Town Council, the Chief of the Fire Department serving the town, or the Town Manager may prohibit any and all burning, as allowed above, when atmospheric conditions or local circumstances may make burning hazardous to health and safety.
