(A) The town may grant the following paid holidays to all eligible employees:
(1) New Year’s Day (January 1).
(2) President’s Day (third Monday in February).
(3) Good Friday (Friday preceding Easter Sunday).
(4) Memorial Day (last Monday in May).
(5) Independence Day (July 4).
(6) Labor Day (first Monday in September).
(7) Columbus Day (second Monday in October).
(8) Veteran’s Day (November 11).
(9) Thanksgiving Day (fourth Thursday in November).
(10) Day After Thanksgiving (fourth Friday in November).
(11) Christmas Eve (December 24).
(12) Christmas Day (December 25).
(B) Eligible employee classification(s).
(1) Regular full-time employees.
(a) A recognized holiday that falls on a Saturday may be observed on the preceding Friday. A recognized holiday that falls on a Sunday may be observed on the following Monday. When Christmas Eve day, or Christmas day falls on a Saturday or Sunday, the town will designate either the preceding Friday or following Monday as the official holiday. If a recognized holiday falls during an eligible employee’s paid time off absence, holiday pay will be provided instead of the paid time off benefit that would otherwise have applied.
(b) To be eligible to receive holiday pay, the employee must be present the working day preceding the paid holiday and the first working day following the paid holiday, or have an excused paid absence.
(c) Holiday pay will be calculated based on the employee’s straight-time pay rate (as of the date of the holiday) times the number of hours the employee would otherwise have worked on that day. If eligible nonexempt employees work on a recognized holiday, they will receive holiday pay plus wages at a rate of time and one-half for the hours worked on that day. Paid time off for holidays will be counted as hours worked for the purposes of determining overtime calculations.
(2) Police officers. If a holiday falls on the officer’s scheduled day to work, the officer has the option of receiving an additional day’s pay or the day off, with pay. If a holiday falls on the officer’s scheduled day off, the officer will receive an additional day’s pay.
