§ 150.02 ABATEMENT OF VACANT AND ABANDONED STRUCTURES.
   (A)   Vacant structures and abandoned structures. Under the provisions of I.C. 36-7-36-1, the town now establishes this abatement of vacant structures and abandoned structures law.
   (B)   State law adopted by reference. I.C. 36-7-36-1 et seq., as may be amended from time to time, is hereby adopted by reference as the town abatement of vacant structures and abandoned structures law. All proceedings within the town for the inspection, repair, and removable of vacant structures and abandoned structures shall be governed by this law and the provisions of this code. In the event the provisions of this code conflict with the provisions of I.C. 36-7-36-1 et seq., then the provisions of I.C. 36-7-36-1 et seq. shall control. Any repeal of the statute shall not act as a repeal of this code.
   (C)   Declaration of public nuisance; abatement. All buildings or portions thereof within the town that are vacant and abandoned structures as defined in I.C. 36-7-36-1 shall be subject to notice and order by the Enforcement Authority pursuant to I.C. 36-7-36-9.
   (D)   Substantial property interest; adoption of state definition. The definition of substantial property interest set forth in I.C. 36-7-9-2 is hereby incorporated by reference herein as if copied in full.
   (E)   Compliance required. Any owner of property as defined in I.C. 36-7-36-4 who is found to be in violation of any of the provisions of this code or I.C. 36-7-36-1 et seq. shall be subject to the penalties as set out in I.C. 36-7-36-10.
   (F)   Enforcement authority. The Building Superintendent of the town is hereby designated the Enforcement Authority in accordance with the provisions of I.C. 36-7-36-2. The Building Superintendent shall be the Chief Administrative Officer of the Building Department of the town and the Building Department acting by and through the Building Superintendent is hereby authorized to administer this code and I.C. 36-7-36-1 et seq. in the town. The Building Superintendent is hereby designated to be the Town Manager, unless the Town Council hereafter by ordinance or resolution designates another person.
   (G)   Hearing authority. The Chief of the Fire Department and the Chief of Police of the town are hereby designated the Hearing Authority in accordance of the provisions of I.C. 36-7-36-3.
