§ 130.07 HUNTING AND TRAPPING ON TOWN PROPERTY.
   (A)   Hunting on town property unlawful; penalty.
      (1)   No person shall engage in the hunting of any animal or fowl on real property owned by the town or any agency or board of the town by any means including but not limited to gun, pistol, firearm, pellet gun, cross bow, bow and arrow, or any other device or weapon. All law enforcement officers of the town are authorized and empowered to enforce this section. The penalty for a first violation of this division is a fine of $100 plus court costs. The penalty for a second violation of this division is a fine of $250 plus court costs. The penalty for a third violation of this division is a fine of $500 plus court costs.
      (2)   This section does not prohibit the following:
         (a)   Destruction of pests, varmints, or dangerous animals by a law enforcement officer or other authorized public authority, provided that the method used shall be done in such a manner as is reasonably designed to prevent injury to humans or other animals;
         (b)   Euthanasia when necessary to prevent prolonged suffering of an injured or sick animal;
         (c)   Destruction of dangerous, vicious, or ferocious wild animals; or
         (d)   Hunting by persons who have been issued a permit to hunt animals on town property. Such permits shall be as authorized by specific declaration of the Town Council and issued under such terms and conditions as specified by the Town Council.
   (B)   Trapping on town property unlawful; penalty.
      (1)   No person shall engage in the trapping of any animal or fowl on real property owned by the town or any agency or board of the town. All law enforcement officers of the town are authorized and empowered to enforce this section. The penalty for a first violation of this division is a fine of $100 plus court costs. The penalty for a second violation of this division is a fine of $250 plus court costs. The penalty for a third violation of this division is a fine of $500 plus court costs.
      (2)   This section does not prohibit the following:
         (a)   Destruction of pests, varmints, or dangerous animals by a law enforcement officer or other authorized public authority, provided that the method used shall be done in such a manner as is reasonably designed to prevent injury to humans or other animals.
         (b)   Euthanasia when necessary to prevent prolonged suffering of an injured or sick animal;
         (c)   Destruction of dangerous, vicious, or ferocious wild animals; or
         (d)   Trapping by persons who have been issued a permit to trap animals on town property. Such permits shall be authorized by specific declaration of the Town Council and issued under such terms and conditions as specified by the Town Council.
   (C)   Exemptions.
      (1)   Officers and agents of the Police Department are exempt from the prohibitions of this section while in the performance of their official duties.
      (2)   Persons who have been issued a permit to hunt or trap animals who are causing damage or destruction to town property are exempt from the prohibitions of this section.
   (D)   Permit. Following approval of a permit by the Town Council, the Town Manager is authorized to issue a written permit on town letterhead stating the name, address, phone number, email and driver’s license number of the person authorized to hunt or trap in addition to specification as to what the driver’s license number of the person authorized to hunt or trap in addition to specification as to what the permit was issued for, all conditions imposed upon the permit and the time frame in which the permit is valid.
