9-5-5: USER FEES; BILLS FOR SERVICE:
   A.   Fees Established; Exemptions: Stormwater utility fees for parcels of land using the utility are hereby established. Such fees, as established in section 3-1-3 of this code, shall be examined by the city council and may be amended from time to time, upon advice of the city engineer (the short title of such fee shall be "SWUF"). All fees shall be just and equitable and in accordance with Minnesota statutes section 444.075. The following land uses are exempt from SWUF:
      1.   Public rights of way.
      2.   Vacant unimproved land with ground cover. (Ord. 2017-01, 1-3-2017)
   B.   Rendition Of Bills: Bills for the SWUF shall be made out by the city in accordance with usual and customary general billing practices for sanitary sewer service. All bills shall be payable at the city administrative office. Bills shall be rendered quarterly. The quarterly amount of the stormwater utility fund is as established by resolution of the city council. (Ord. 98-12; amd. 2005 Code)
   C.   Payment Of Bills; Delinquencies: Payments shall be made in accordance with the billing not later than the fifteenth day of the following month. A late charge as established in section 3-1-3 of this code will be charged if bills are not paid by the due date, subject to a minimum charge in an amount as established in section 3-1-3 of this code. If bills are not paid within thirty (30) days from the date of billing, they shall be deemed delinquent; in case of delinquency, mailed notice shall be sent; and after three (3) days following such mailing, civil action may be begun on behalf of the city for the collection of said SWUF. If such fee is not paid within sixty (60) days after due, the said unpaid fee, plus late charges, may be certified to the county auditor with the taxes against such property and shall be collected with other taxes on such property. The fee shall be deemed a charge against the owner, lessee and occupant of the property served. Such certification to the county auditor shall not preclude the city or its agents from recovery of such delinquent fee or charge, late charge and interest thereon, by other available remedies.
