7-3-2: DEFINITIONS:
For the purposes of this chapter, the terms defined herein shall have the following ascribed meanings:
ALL-TERRAIN VEHICLE:
A motorized floatation-tired vehicle on not less than three (3) low pressure tires and not more than six (6) tires. All-Terrain Vehicle includes Class 1 and Class 2 All-Terrain Vehicles as defined below.
   Class 1 All-Terrain Vehicle:
Class 1 All-Terrain Vehicle means an All-Terrain Vehicle that has a total width from outside of tire rim to outside of tire rim that is fifty (50) inches or less and a total dry weight of less than nine hundred (900) pounds.
   Class 2 All-Terrain Vehicle:
Class 2 All-Terrain Vehicle means an all-terrain vehicle that has a total width from outside of tire rim to outside of tire rim that is greater than fifty (50) inches but not more than sixty-five (65) inches and a total dry weight of nine hundred (900) to one thousand five hundred (1,500) pounds.
MOTORCYCLE:
Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground, including motor scooters and bicycles with motor attached, other than those vehicles defined as “motorized bicycles” in this section, but excluding a tractor. “Motorized bicycle” includes an “electric assisted bicycle” as defined by state statute.
MOTORIZED BICYCLE:
A bicycle with fully operable pedals which may be propelled by human power or a motor, or by both, with a motor with a capacity of less than fifty (50) cubic centimeters piston displacement, and a maximum of two (2) brake horsepower, which is capable of a maximum speed of not more than thirty (30) miles per hour on a flat surface with not more than one percent (1%) grade in any direction when the motor is engaged.
MOTORIZED GOLF CART:
Motorized golf cart means a vehicle usually three (3) or four (4) wheeled which is self-propelled and is designed to be used to provide transportation on a golf course.
OPERATE:
To ride in or on and control the operation of a snowmobile or recreational motor vehicle.
OPERATOR:
Every person who operates or is in actual physical control of a snowmobile or recreational motor vehicle.
OWNER:
A person, other than a lien holder, having the property in or title to a snowmobile or recreational motor vehicle.
PERSON:
Includes an individual, partnership, corporation, the state and its agencies and subdivisions, and any body of persons, whether incorporated or not.
RECREATIONAL MOTOR VEHICLE:
Trail bikes, amphibious vehicles and similar devices, other than snowmobiles, used at least partially for travel on natural terrain, but not “special mobile equipment” as defined in Minnesota statutes section 168.011, subdivision 22, which is hereby incorporated herein by reference; also including any self-propelled vehicle and any vehicle propelled or drawn by a self-propelled vehicle used for recreational purposes, including, but not limited to, a motorized bicycle, all-terrain vehicle, motorcycle, hovercraft or motor vehicle licensed for highway operation which is being used for off road recreational purposes. This definition includes “off highway motorcycles” as defined in Minnesota statutes section 84.787, and “all-terrain vehicles” as defined in Minnesota statutes section 84.92.
RIGHT OF WAY:
The entire strip of land traversed by a highway or street in which the public owns the fee or an easement for roadway purposes.
ROADWAY:
That portion of a highway improved, designed or ordinarily used for roadway purposes.
SNOWMOBILE:
A self-propelled vehicle designed for travel on snow or ice and steered by skis or runners.
STREET:
A public thoroughfare, roadway, alley or trail used for motor vehicular traffic which is not an interstate, trunk, county state aid road or county highway. (Ord., 1988; amd. Ord. 1997-5, 5-6-1997; 2005 Code; Ord. 2021-06, 4-5-2021; Ord. 2022-05, 6-20-2022)
