7-1-3: VEHICLES ON WASTEWATER TREATMENT CONTROL DIKE:
   A.   Definitions: For the purposes of this section, the words and phrases defined in this subsection shall have the meanings herein given them:
       ALL-TERRAIN VEHICLE: A motorized flotation tired vehicle of not less than three (3) low pressure tires, but not more than six (6) tires, that is limited in engine displacement of less than eight hundred (800) cubic centimeters and total dry weight less than nine hundred (900) pounds.
      CONTROL DIKE: An embankment, ridge, bank, barrier of earth, rock or other materials that encloses or restrains the wastewater of the city of Albertville wastewater treatment facilities or ponds. It includes both inside and outside bank or slope of the control dike and abutting land supporting the control dike.
      MOTOR VEHICLE: Every vehicle which is self-propelled and not deriving its power from overhead wires. "Motor vehicle" does not include an electric personal assistive mobility device or a vehicle moved solely by human power.
      MOTORCYCLE: Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground, including motor scooters and bicycles with motor attached, other than those vehicles defined as "motorized bicycles" in this subsection, but excluding a tractor.
      MOTORIZED BICYCLE: A bicycle with full operable pedals which may be propelled by human power or a motor, or by both, with a motor of a capacity of less than fifty (50) cubic centimeters piston displacement, and a maximum of two (2) brake horsepower, which is capable of a maximum speed of not more than thirty (30) miles per hour on a flat surface with not more than one percent (1%) grade in any direction when the motor is engaged. A "motorized bicycle" includes an "electric assisted bicycle" as defined by state statute.
      RECREATIONAL MOTOR VEHICLE: Trail bikes, amphibious vehicles and similar devices, other than snowmobiles, used at least partially for travel on natural terrain, but not "special mobile equipment" as defined in Minnesota statutes section 168.011, subdivision 22, which is hereby incorporated herein by reference; also including any self-propelled vehicle and any vehicle propelled or drawn by a self-propelled vehicle used for recreational purposes, including, but not limited to, a motorized bicycle, all-terrain vehicle, motorcycle, hovercraft or motor vehicle licensed for highway operation which is being used for off road recreational purposes. This definition includes "off highway motorcycles" as defined in Minnesota statutes section 84.787, and "all-terrain vehicles" as defined in Minnesota statutes section 84.92.
      SNOWMOBILE: A self-propelled vehicle designed for travel on snow or ice and steered by skis or runners. (Ord. 1990-1; amd. 2005 Code)
   B.   Operating Or Parking On Control Dike Restricted: No person shall drive, operate or park any motor vehicle, all-terrain vehicle, motorized bicycle, motorcycle, recreational vehicle or snowmobile on or over the control dike, except for any such vehicles owned and used by the city for official business or that have received advanced written permission from the city council.
   C.   No Trespassing Sign: The city administrator shall cause one or more "no trespassing" signs to be posted at or around the perimeter of the control dike. Failure to install or maintain any such sign shall not be a defense to violation of this section. (Ord. 1990-1)
   D.   Misdemeanor Violation; Penalties: Any person violating any provisions of this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided in section 1-4-1 of this code. (Ord. 1990-1; amd. 2005 Code)
