5-4-4: NUISANCE DECLARED; ABATEMENT:
Except as open burning is otherwise authorized by this chapter, open burning without a permit is hereby declared to be a public nuisance 1 . The fire chief or his/her designated representative may summarily abate such nuisance without notice to any party. In the event that it becomes necessary to abate such nuisance, the fire chief or his/her designated representative may, at his/her sole discretion assess a fee which shall be set from time to time by the city council by resolution against the owner of the property or the person responsible for the burning where the public nuisance is created. If not paid within thirty (30) days of the date of the assessment, the said assessment may be declared an assessment against the property involved. (Ord., 5-4-1987)
